The manufacturer of a complex marine heat exchanger was sued by a customer that had experienced widespread failures of the components in their system. The complaint claimed defective design, manufacturing, and inspection.

MME was retained to evaluate the failures, as well as the internal investigations conducted by both the manufacturer and end user.

MME’s analysis revealed no defective condition with respect to the design or workmanship of the heat exchangers, and further identified undisclosed operating parameters for the plaintiffs systems that were the root cause of the failures. MME provided expert testimony on behalf of the manufacturer (defendant) at trial. The jurors rendered a verdict 100% in favor of the defense.
